Who is liable for a broken window in a rental property?

December 12009

Ok, so I know I am…I’m the one who broke it. The thing is, it is a flowery pattern glass. I broke the small window pane, at the bottom. There is a larger one above it, still perfectly fine. By law I have to fit safety glass in, and it doesn’t come in the old original pattern. The realestate said I’d have to pay to fit new glass for the unbroken top piece as well, so they both match.
Does that seem right?

Yes, you want the door to look decent.

You may be able to have a piece crafted, do not assume you need tempered glass, you usually do not on a framed door. If you are within 5 feet of stairs, yes, but otherwise check.

Is it common, advisable or necessary to put all real estate holdings into a trust fund?

November 262009

I have several realestate properties and would like to know the advatages or disadvantages.

Thanks for any insight.

I would definately encourage you putting your real estate holdings into a trust fund. I believe a trust fund is the same as a corporation. Either way it protects your assets. If you get into a car accident they cannot sue you for your property. It is protected. Also I believe it is part of a will which is always great, ya never know when your number is called! Its better to be protected any way possible.

Good luck to you and all the ventures that come your way!

Do you have a question?

Found a vacant lot in Texas, no taxes being paid or owners name on title to the property. How to proceed?

November 222009

I was researching taxes on a property in Texas, much to my amazement, I ran along a property that doesn’t have title or anyone paying taxes (I couldn’t believe that someone at the tax office missed this one) but I need some direction. Does someone know realestate law in Texas? How do I get title to the property? Thanks in advance.

The better odds are that SOMEBODY has title to the lot. You would have to do a title and chain of title search (not clear above that you did one). It is probably "part" of another tract of property. My money would be on the idea that the tax department overlooked it and some individual is benefiting by not being billed.

Can you sue a business for lowering your property value?

November 202009

My neighborhood was a quiet place with restrictive covenants. A business next to our neghborhood expanded to within 20 feet of my property and put a truck repair shop that works sometimes up till 10:30 at night . We have to hear air compressers run 24 7 , 18 wheelers pass within 30 feet of my bedroom and they call each other over an outdoor intercom system that you can hear for three or four blocks . A realestate agent told me i will never be able to sell like it is

Petition your county to have your home designated commercial. Then sell for about twice what it’s worth. P.S. Your agent is an idiot. You’ve literally just hit a financial jack pot.

do i need a lawyer to do a title search for liens against realestate properties?

November 172009

in washington co pa

Although there is no legal compulsion but yes, you need a lawyer to do a title search for liens against a real-estate property. Because the lawyers are well aware of the nitty-gritty of the title search. Also lawyers can also explain you the real position of the title like is it a freehold estate, a leasehold estate or anything else. You yourself will not be able to identify them.

Go to legal500.com or any other site to find a good lawyer in the Washington co PA

what is the projected rental rate increase for 2007 for commercial realestate properties for the east coast?

November 142009

There is none based on the way the question was asked.

Commercial property varies a lot by type. Multi-family residential, office, retail, light industrial, heavy industrial and some other categories.

Each community has a mix and depending on local conditions prices and rents reflect the demand vs. supply. One community can have rising office rents because of local demand while the next community has a surplus and falling rents.

The east coast runs from Maine to Florida. NYC will have on level for A class office space and another for B class office space. When you get down to Georgia you would expect different rates.

You need to narrow the search if you want to get meaningful data. Otherwise you will have a blend but not likely a rate that you can obtain in any one market

When changing ownership on a piece of real estate property, Can you kick out old tenants?

November 102009

My friend is buying a piece of realestate (multiplex) with tenants with one year leases. He wants to move in immediatly. Can he cancel old leases and kick them out or what because he will be the new owner of the property?

No, he cannot automatically change any existing leases. How would you feel if it were you. When you buy a property you also buy any existing leases and they must be honored to the fullest extent.pp

Who is the legal owner of chattel property/motor vehicles left behind in a bank forclosed property in WI?

November 72009

Specifically regarding the disposition of a motor vehicle located within the premises after foreclosure and repossesion by the realestate mortgage holder. The vehicle appears to have lien that was written off and there appear to be no current liens in effect. Ultimately who has a legal claim to the vehicle in question? If the bank contracted with a local company to remove and dispose of personal property contents within the home will the cleaning company have a legitmate claim to the vehicle? How would the vehicle be titled?

If you have bought this home, you could call & inquire the laws regarding abandoned vehicles. Sometimes a tow company will take them to impound & if not claimed by the owner after public notice, will sell them at auction.

The Bank and agent representing the property should perform some due diligence to remove the vehicle. Yet some may make it the responsibility of the new owner.

The person hired to handle getting rid if the personal propery and trash left in the home are typically unskilled laborers or hourly cleaning service that may not have means of removing the vehicle.

You would need to inquire with the real estate agent that will be handling the listing of the home to determine the fate of the vehicle.
