dividing realestate property?

We own a half acre lot with two rental homes on them. They both run off the same sewer and same water utilities. They do have separate gas and electricity bills. They are no connected. One large house in the front and a small rental in the back. I would like to separate the property. The zoning in my area calls for one living unit for every half acre. We have had two on this property for over 20 years. Can I divide the property and sell a portion? Where do I go to find the information that I need?

I suspect if the zoning says 1 per 1/2 acre you are out of luck selling one off with less thatn that. But as Ace said call the zoning board. You will have a very expensive, in the thousands of dollars, bill for separating that sewer and water lines.

A couple of years back I tried to fight city hall on just such an issue, I lost.

Realestate sale fees?

I may back out of my house sale because of fees.Inspection wasnt done yet,so I should be able to cancel,its my house.They want 5800 sale fee,639 to check for liens,495 administration fee,200 water bill fee.Is this nuts?$495 should be in the 5800 commision fee,right,I will have a loss of $17000 if I go through with these costs.If I sell,will they force these fees on me?I dont want to sell.
I have $123,000 invested,only owe $81,000 ,but will only walk away with $27,185.We did the math and will be neg $17000.Agent only will say fees are normal,almost $9000 fees? Crazy.being a 2 family I lived in for 7 yrs,I was told I may have to pay a gains tax?I lost $17000 according to my accountant( not including interest and property taxes paid)There was no gain.People here say just do what we say,no questions or i will hurt their feelings.wow.

You are getting cheated if all these fees weren’t disclosed to you in advance. But we can’t know the complete situation. If you are getting a $300,000 profit when the sale closes, no one is going to feel sorry for you. Just refuse to pay the administrative fee. Unless you completely understood it when the house went up for sale. A contract is not a contract unless there is a "meeting of the minds".

realty agency discriminates against discount brokers, legal action?

A local realestate agency does not list any MLS listing on her site the PRMOTES ALL MLS listings that are listed by dicount brokerages. She is by far the biggest agency in my area, accounting for nearly half of all home sale listings. Some refer to it as a monopoly.

Since she promotes that her search engine on her site pulls up all MLS listings, could some one not seek a liability case? I know it is against the law for realtors to intentionally bypass FSBO listings, or dicounted brokerage listings. What is amazing is 95% of these sellers she bypasses in her system ARE OFFERING 3% to a selling agent. The other few are offering 2.5%.

I’m one of those excluded, despite being in the MLS and offering a commission. I had my brother call her agency about my home, they told him "it is not something you would be interested in, trust me!" They have never even seen it! Do I have a case?

This is an interesting question.

If she is advertising that she is allowing searches of all MLS properties and is screening out discount brokers and or lower commission offerings I would think that you could file a complaint against her with the MLS, local board of Realtors (if she is a Realtor), the state regulatory agency for agents/brokers for false advertising. You could contact the federal anti-trust attorney(s) they are always happy to look into real estate brokerages. By the way if they can turn up a antitrust case you get treble damages (if you can show that you were damaged).

is there really such a thing as no money down on buying realestate if so where do I find this place thank you?

I have a dissability that keeps me from practicing my current accupation and I would like to make a good liveing still and belive I can succeed in realestaste if there really is a way with no money down help man tierd of dissability

You will not have to pay mortgage insurance if you break the loan up into an 80/20 piggy back loan. There are many ways to finance investment properties to 100% even with stated income. However you will have to have good credit scores and cash reserves of between 4-6 months (depending on the lender).

Realestate agents? Are you the one who is supposed to find the lender or is the buyer?

I live in NC. Im not sure if that matters. Anyways, my friend is looking for a house and he has gone with someone who has just finished up their realestate classes and recieved their license. The realator calls my friend and tells him "Hey I got a number of a guy YOU need to call and talk to…I think he will give you a good rate." He has yet to help him even FIND a mortgage company. I dont think my friend knows where to start. he assumed and so did I that the agent was supposed to help with that. Am I wrong or should the agent be taking the personal information to find him a lendor or at least giving him a list or lenders to contact?

First of all, I think I would rather work with someone more experienced, as buyers need considerably more expertise than a newbie can provide.
As for mortgage and closing that is up to the buyer. As part of my services, I generally give me clients some names and let them choose. They should talk with at least three lenders to see what different programs are available and of course rates. While I can make arrangement for closing, I always ask if they prefer one place over another. Most folks don’t know title companies like they do lenders.

Nowadays, some Realtors (depending on the client relationship) do not want to know the borrowers financial information. For example, if the borrower is purchasing a property the agent has listed (dual agency), then it’s best if the borrower keeps his financial information confidential. Since I am not a mortgage professional, I leave most of the qualifying up to the lender. I am happy to accompany the client to each lender, but it’s not necessary. If I’ve worked the area for awhile, I know most lenders. And in some places, each real estate company has their own loan divisions and/or title companies. Again, the buyer can select whom they want to work with.

Whatever wireless service you have in your area and talking to people you know living there will be the best referral for that, is what will be most important. Also, as long as it has enouth memory for a program that you use for realestate and your book keeping that sort of thing. Dell is probably the best. if you are going to share files with your desktop you may not need as much memory for those programs, pictures take a lot of memory. So, Dell will design a unit just for your needs. They are great about that. They will try to sell more than you might need so really talk to other business people and see what their experience has been before you do anything. My first Gateway…first computer ever they sold me way more than I needed in programs so, I know they all do it. Just know what you want before you call and go for lots of storage and memory and speed/ Good luck.

What is the logo or logos that go on a realestate agents business card?

I am doing a business card for a client. Do I put the equal housing opportunity logo? My client says she needs the Fair Housing logo… Isn’t that the same thing. She say the equal housing opportunity logo is for equal opportunity for people. I say that equal opportunity not equal housing opportunity….. I need to send these cards off. Please any realestate agent or anyone who knows reply… Thanks

You are right. Go to National Association of Realtors website and look at the logos. The picture of a little house with the writing on them. Make sure you don’t use the one for mortgages.

Agents do all of the work, the listing and selling of homes negotiate real estate contracts, the whole nine yards for a commission that they split with the broker, and are lisenced by the state in which they practice but cannot work, unless employed by a licensed broker with an office. The state of Oklahoma will not issue an agent a lisence but instead sends to a brokerage office that they have chosen to work for. A broker in oklahoma is a real estate agent with a minimum of 2 years of experience and additional brokerage training.
